By creating an account, accessing, or using the HiringScout platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.
We may update these Terms from time to time. We will notify you of material changes via email and in-platform notification at least 14 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
HiringScout is an AI-powered hiring platform that provides resume screening, AI call screening, structured interview evaluation, candidate management, and related hiring workflow tools. The Service is provided as a software-as-a-service (SaaS) offering.
We aim for 99.5% monthly uptime. Planned maintenance windows will be communicated with at least 24 hours notice. We are not liable for downtime caused by factors outside our reasonable control, including third-party service failures, internet disruptions, or force majeure events.
Features marked as "Beta" or "Preview" are provided as-is and may be changed or removed at any time. Beta features are not covered by uptime commitments.
You must provide accurate, current, and complete information during registration. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You must notify us immediately at security@hiringscout.com if you suspect unauthorized access.
Company accounts may invite team members. The account owner is responsible for ensuring all team members comply with these Terms. Access permissions can be managed in your account settings.
We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or are used to harm candidates or other users. We will provide notice before suspension unless immediate action is required for security reasons.
The Service may be used only for legitimate hiring and recruitment purposes by authorized users. You must comply with all applicable employment laws, anti-discrimination laws, and data protection regulations in your jurisdiction when using the platform.
You may not: use the Service to discriminate against candidates based on protected characteristics; use AI evaluations as the sole basis for rejecting candidates without human review; scrape, reverse-engineer, or extract data from the platform in unauthorized ways; use the Service to send unsolicited communications; or attempt to circumvent any security or access controls.
AI-generated evaluations are designed to assist human judgment, not replace it. You agree to maintain human oversight of hiring decisions and to not use AI scores as the sole and final basis for rejecting candidates. This is both a legal requirement in many jurisdictions and a condition of your use of the Service.
You retain ownership of all content you upload to the Service — job descriptions, company information, and data about your hiring processes. By uploading content, you grant HiringScout a limited license to process and display that content to deliver the Service.
When you access candidate profiles and evaluations through HiringScout, you agree to use that data only for the purpose of evaluating candidates for the specific role for which they applied. You may not share candidate data with third parties or use it for purposes beyond the hiring process without the candidate's explicit consent.
Upon termination of your account, we will delete your data within 90 days. You may export your data at any time before termination using the built-in export tools.
Paid plans are billed in advance on a monthly or annual basis. Prices are listed on our pricing page and are exclusive of applicable taxes, which will be added at checkout based on your billing location.
You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period — you retain access to the Service until then. We do not provide prorated refunds for unused portions of a billing period, except where required by law.
If a payment fails, we will attempt to process it three times over 7 days. After three failed attempts, your account will be downgraded to a free plan. Your data will be retained for 90 days, giving you time to update your payment method and reactivate.
The Service, including all software, AI models, algorithms, interfaces, and documentation, is owned by HiringScout, Inc. and protected by copyright, patent, trademark, and other intellectual property laws. These Terms do not grant you any ownership interest in the Service.
If you provide feedback, suggestions, or ideas about the Service, you grant HiringScout a perpetual, irrevocable, royalty-free right to use that feedback in any way, including incorporating it into the Service without compensation or attribution.
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, THAT AI EVALUATIONS WILL BE ACCURATE, OR THAT THE SERVICE WILL MEET YOUR SPECIFIC REQUIREMENTS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HIRINGSCOUT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM.
You are solely responsible for all hiring decisions made using the Service. AI-generated evaluations are tools to assist your judgment — HiringScout is not liable for outcomes of hiring decisions, including claims of discriminatory hiring, regardless of whether AI evaluations were used.
These Terms are governed by the laws of the State of California, without regard to its conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Santa Clara County, California.
Before initiating formal proceedings, both parties agree to attempt to resolve disputes informally by contacting legal@hiringscout.com. We will make a good-faith effort to resolve the dispute within 30 days.
